Why US Clients Demand a W-9

If you are a freelance developer or designer working with a client based in the United States, you will almost certainly be asked to provide a W-9 (if you are a US citizen/resident) or a W-8BEN (if you are an international contractor).

Clients aren't asking for this to steal your data. They are legally required by the IRS to collect this form so they can issue a 1099-NEC form at the end of the year, which proves to the government that they paid an independent contractor, not a full-time employee.

1. For US-Based Freelancers (Form W-9)

The W-9 is straightforward. You must provide your Name, Business Name (DBA), Address, and Taxpayer Identification Number (TIN).

Critical Security Warning: Do not put your Social Security Number (SSN) on a W-9 if you can avoid it. Instead, apply for a free Employer Identification Number (EIN) from the IRS website. Using an EIN protects you from identity theft when emailing documents to dozens of different clients.

2. For International Freelancers (Form W-8BEN)

If you operate outside the US, US clients cannot issue you a 1099. However, they still need proof for the IRS that they paid a foreign entity. You must fill out the W-8BEN (for individuals) or W-8BEN-E (for companies).

  • Part I: Fill in your name, country of citizenship, and permanent address.
  • Part II (Claim of Tax Treaty Benefits): This is crucial. Depending on your country (e.g., India, UK, Canada), you may claim a 0% withholding rate under an international tax treaty. If you skip this, the US client might legally withhold 30% of your invoice!

3. How to Send These Forms Safely

Never send a W-9 or W-8BEN as an unprotected email attachment.

  1. Use a secure, encrypted storage link.
  2. Ensure your actual invoice is professional and clearly states your contractor status. Use our Free Secure Invoice Maker to generate localized, compliant PDF invoices in seconds.
